New Information
The Countywide Recycling and Disposal Facility in East Sparta, Ohio, received a letter, dated November 19, 2007, from the Stark County Health Department stating that the Health Commissioner, Mr. William Franks, is planning to make a recommendation to the Stark County Board of Health that the facility's operating license be suspended.
The managers of Countywide are obviously disappointed in the Commissioner's action. We disagree with the Commissioner's recommendation and will pursue all legal remedies available to enforce the company's legal rights and ensure the facility is granted an operating license.
Background
Six months ago, on May 18, 2007, the Stark County Health Department issued Countywide a license to operate.
Countywide submitted an application for its 2008 operating license to the Stark County Health Department on September 24, 2007. This license renewal application is currently pending.
The remediation of the older portion of the landfill is continuing in conjunction with the Ohio EPA. The Health Commissioner's recommendation will not impact the remediation that is currently ongoing.
Countywide's Position
- Countywide meets all of the criteria for the renewal of the license and therefore is entitled to continue landfill operations.
- Countywide will pursue available legal remedies to maintain our current license and secure our 2008 license.
- We anticipate that Countywide will continue to operate as normal as we work to resolve this regulatory issue.
